The Automobile Guarantee Fund (FGA) is liable to third parties who suffer damage in traffic accidents in Portugal when there is no compulsory civil liability insurance for the vehicle that caused the accident and, under certain conditions, guarantees payment for the damage caused by that vehicle, even when it is unidentified.
The FGA is only liable for repairing damage caused by accidents involving vehicles:
– subject tocompulsory motor vehicle liability insurance, with habitual parking in Portugal or registered in a country that does not have a National Insurance Service (Green Card), or whose Service has not adhered to the Agreement between National Insurance Services;
– subject to compulsory motor vehicle liability insurance without a license plate, or with a false license plate;
– not subject to compulsory motor vehicle liability insurance due to the vehicle itself, even if it is usually parked abroad;
– subject to compulsory motor vehicle liability insurance, which has been imported from a Member State, for a period of 30 (thirty) days from the date of acceptance of delivery by the purchaser, even if the vehicle has not been formally registered in Portugal.
IMPORTANT
The FGA pays compensation but requires those responsible to reimburse the amounts spent. It is therefore important that you keep your compulsory motor vehicle liability insurance valid.
